Week 6 Assignment: Discuss the Rules Governing Ethics Committees and the Application of Ethics Within Health Care

Introduction

This blog will talk about how a bioethics committees work and what kind of rules govern the committee. The blog will also look at how the bioethics committees decide on issues of morality. The blog will discuss issues that influence medical ethics and the application of the ethical.

The Committee

Most committees are a group of people that have diverse backgrounds. Most of the members represent major clinical services in the local health care area. The committee would have physicians and nurses in surgery, and psychiatry, social workers, chaplains, and community representatives. (University of Washington, 2016) The committee can also have a lawyer, someone that works on the education program, and someone trained in ethics. It may be hard to development the ethics committee at first but with the support of the hospital and doctors it can come together. The committee needs to know what it can offer the hospital it can start with some cases that have made problems for the staff and things that have been in the past. The committee should have a written statement of its goals and functions. The committee can have a broad range of ethical issues to take care of, and that can include clinical care issues, patient advocacy concerns, and conflicts of care. (HCA Management Services, L.P. , 2016)

Ethics Consultant

You can ask for a consultant when two items are met. One being there is an ethical problem in the care of a patient and the other being the health care providers has not established a resolution that is agreed upon by the patient and the clinicians. (University of Washington, 2016) There can be a consultant even if there is no patient care issue and there may be an ethics policy issue like the clinicians has no professionalism, patient privacy, or ethical practices in the workplace, human resources, resource allocation, or the business practices of the institution. (University of Washington, 2016)

Health Insurance Portability and Accountability Act (HIPAA)

Health Insurance Portability and Accountability Act (HIPAA) privacy now have civil monetary penalties for disclosures of protected health information (PHI). The ethics committee needs to be sure to protect the health information are in the case reviews and other functions of the committee. (HCA Management Services, L.P. , 2016) The Health Insurance Portability and Accountability Act (HIPAA) privacy will allow ethics committees to use protected health information (PHI) to see the important of the ethical case.

Issues of Morality

Morality is a code of conduct that people follow in the world. A moral dilemma is the right and wrong thing go against each other. So that makes morals what is right and wrong. The ethics committee has to make the moral judgment in cases to see what the right action for the problem. The ethics committee has to rely on some theories that are the framework of what has formed the medical ethics. Here is a list of ethical principles by Pozgar.

• Normative ethics – seeks to determine the moral standards to be adopted to ensure morally correct behavior. (Jaymaica, 2016)
• Consequential Ethics – determines that the morality of an action be the optimization of the balance of good versus evil. It is accomplishing the greatest good for the greatest number. (Jaymaica, 2016)
• Situational Ethics – Thus given circumstances determine the course of action, not necessarily adhering to moral values. (Jaymaica, 2016)
• Deontological Theory – It is proceeding on a course of action based on duty bound obligations. (Jaymaica, 2016)
• Nonconsequential Ethics – The rightness of wrongness is found inside the action and not the consequences. (Jaymaica, 2016)
• Ethical Relativism – Morality or the concepts of right or wrong are based on the cultural norms of the society. (Jaymaica, 2016)

Issues that Influence Medical Ethics

There is going to be many problems that the ethics committee will have to deal with when making a decision. Here is a list of items that may influence the decision.

• Disagreement between patients/families and health care professionals about treatment decisions (Breslin, MacRae, Bell, & Singer, 2005)
• Waiting lists (Breslin, MacRae, Bell, & Singer, 2005)
• Access to needed health care resources for the aged, chronically ill and mentally ill (Breslin, MacRae, Bell, & Singer, 2005)
• Shortage of family physicians or primary care teams in both rural and urban settings (Breslin, MacRae, Bell, & Singer, 2005)
• Medical error (Breslin, MacRae, Bell, & Singer, 2005)
• Withholding/withdrawing life sustaining treatment in the context of terminal or serious illness (Breslin, MacRae, Bell, & Singer, 2005)
• Achieving informed consent (Breslin, MacRae, Bell, & Singer, 2005)
• Ethical issues related to subject participation in research (Breslin, MacRae, Bell, & Singer, 2005)
• Substitute decision-making (Breslin, MacRae, Bell, & Singer, 2005)
• The ethics of surgical innovation and incorporating new technologies for patient care(Breslin, MacRae, Bell, & Singer, 2005)
